APOLOGIES FOR ABSENCE

Minutes:

There were no apologies for absence intimated.

 

Having noted that Councillor Brown had originally been selected as a member of the Local Review Body to consider the case outlined at agenda item 3 (Consider Notice of Review Request:  50 Charlotte Street, Helensburgh, G84 7SR (Ref:  24/0005/LRB)), the Governance, Risk and Safety Manager advised that Councillor Mark Irvine was in attendance in her place as she was unable to attend due to attending the funeral of Councillor Robin Currie.  It was noted that in terms of the process, as advance notice had been given and as the case had not yet been considered by the Local Review Body, that this was an acceptable way of ensuring that the Local Review Body was quorate and the meeting could proceed.

The Chair, Councillor Green, welcomed everyone to the meeting.  He explained that no person present would be entitled to speak other than the Members of the Local Review Body (LRB) and Mr Jackson, who would provide procedural advice if required.

 

He advised that his first task would be to establish if the Members of the LRB felt that they had sufficient information before them to come to a decision on the Review.

 

Councillor McCabe confirmed that she felt she had sufficient information to come to a decision on the Review.

 

Councillor Irvine confirmed that he also felt he had sufficient information to come to a decision on the Review.

 

The Chair, Councillor Green advised that he considered the information before him to be very comprehensive. 

 

Councillor McCabe advised that as the proposal was to simply straighten off the existing driveway and not to extend it, she had no objection to the application.  She advised that she could appreciate the difficulties in moving passed any parked vehicles, particularly with a pram or wheel chair and of exiting a parked vehicle if other vehicles were also parked close by.  

 

Councillor Irvine noted the reference in the pack to the enforcement case relating to the removal of the grass verge and replacement with hardstanding and asked Mr Jackson if the hardstanding as it was shown in the photographs was the subject of the enforcement action.

 

Mr Jackson advised that he wasn’t able to clarify that matter but it was his understanding that if Members were minded to approve the Notice of Review Request, any enforcement action would cease. 

 

 

Councillor Irvine advised that in that case he agreed with Councillor McCabe’s point of view as he too could see the issues with the current arrangement, particularly in relation to pedestrian access and the possibility of slips and falls. 

 

Having taken into consideration discussions in relation to a competent Motion and possible conditions, Mr Jackson provided advice on the process, should Members be minded to approve the Notice of Review Request.

 

Decision

 

The Argyll and Bute Local Review Body unanimously agreed to:-

 

1.    request that the Planning Department provide draft conditions to be attached to the application should the Local Review Body determine that it is appropriate to approve the Notice of Review Request; and

 

2.    continue consideration of the Notice of Review Request to allow Members to seek advice on preparing a competent Motion to approve.
