What information do we need?
Argyll and Bute Council will act as the ‘Data Controller’ in regard to the personal data you provide to us. The Data Protection Officer can be contacted at the Council’s headquarters, Kilmory, Lochgilphead, PA31 8RT. The email address is: data.protection@argyll-bute.gov.uk
The information we need to collect will include basic personal data such as name and age, however we will also need special categories of data such as medical and health conditions, additional support needs and gender. Other information may be required but we will only ask for data that is needed to help us to provide support for you. The information may come from a variety of sources, including those people already involved with you such as your parents or carers, teachers and support staff at your school, health professionals such as speech and language therapists and paediatricians or a social worker who knows you and your family.
We will also take into account your views.
If you or your parent/carer tell us that another professional has become involved with supporting you, it may be helpful to ask them if they will share any relevant information with us.
Why we need this information?
Your information is being collected for the following purpose(s):-
We need information to help us to understand the wellbeing concern with which you or the school would like us to assist. We will not collect any personal data from you that isn’t needed. We will use this information to assess your wellbeing need and, if appropriate, create a Child’s Plan which will detail interventions to support your wellbeing.
The legal basis for collecting your information in these circumstances is:
Article 6(1)(e ) – Public Task on the basis of the legal obligation placed on the Education Authority to produce Child’s Plans:
- Children and Young People (Scotland) Act 2014
Article 9(2)(g) - special categories of data can also be collected for reasons of substantial public interest for aims that are proportionate and which contain appropriate safeguarding measures.
What we will do with your information?
All of the information we collect from you will be processed by staff in the United Kingdom. Your information will be shared with the recipients or categories of recipients detailed below:-
Following Getting it right for every child (GIRFEC) principles, to ensure that children and young people get the help they need, we often have to share some of the information we have with other agencies. For example, information on our involvement is usually shared with school, and sometimes with other education service staff, speech and language therapists or other health professionals who are already involved with your child. We will only share information with other Council services where this is necessary to allow us assess your wellbeing need or implement the interventions described in a Child’s Plan.
We may also be asked to share information with outside bodies. These bodies include the Scottish Children’s Reporter’s Administration, HMIe and Education Scotland. We will only share information with an outside body if you are the subject of a Child’s Plan. If you are not currently the subject of a child’s plan but one is later required, we may then share information with an outside body.
You should also be aware that your data will be stored on servers located within the United Kingdom; the data will not be processed outside the UK and EEA. Some of the information we hold is in paper form and kept in an individual file in a locked cabinet. We will take all reasonable steps to ensure that your data is kept securely and more information on how we do this is provided on the Council website (www.argyll-bute.gov.uk) or can be provided in paper format on request to the Central Education Team, using the contact details below.
How long will we keep your information?
We will usually keep your information until you are 25 years old, after this period it will be destroyed under secure arrangements if it is no longer required for the lawful purpose for which it was obtained. For children and young people who are currently or have been Looked After and Accommodated by a local authority, files will be kept indefinitely in line with the requirements and recommendations of the Scottish Child Abuse Inquiry (SCAI). More information on our retention schedule is provided on the Council website (www.argyll-bute.gov.uk ) or can be provided in paper format on request to the Central Education Team.
Your rights
When you provide information to the Council, you will have the following rights:
- to withdraw consent at any time, where the legal basis specified above is consent
- to lodge a complaint with the Information Commissioner’s Office
- to request access to your personal data
- to data portability, where the Legal basis specified above is i) consent or ii) performance of a contract
- to request rectification or erasure of your personal data, as so far as the legislation permits
