Your Personal Data
Argyll and Bute Council will act as the ‘Data Controller’ for the personal data you provide to us. The Data Protection Officer, who is responsible for ensuring personal data is managed in accordance with data protection legislation, can be contacted as follows:

What information do we need?
The information we collect from you will include details such as your name, address, e-mail address, date of birth and job title.
We also use more sensitive types of personal information, including information about racial or ethnic origin; political opinions; religious or philosophical beliefs; genetic and biometric data, health; sex life or sexual orientation.
The information we use can relate to personal and family details; education, training and employment details; financial details; lifestyle and social circumstances; visual images; details held in the service user record.
We also need to ask about all members of your household, in particular adults including current and previous partners.
Why we need this information?
Your information is being collected for the following purpose(s):-
We use this information to enable us to provide services; research and management information; supporting and managing applicants; maintaining our accounts and records; public protection.
If you do not provide this information then we will be unable to progress your application to become adopters.
We will not collect any personal data from you that isn’t needed for our consideration of your application to be assessed and approved as adopters.
The lawful bases for collecting your information in these circumstances are:-
Article 6(1)(a) and Article 9(2)(a) Consent – we will obtain your consent to process both personal and special category information as part of the application process and the processing of this information is required to approve you as adopters.
Article 6(1)(c) Legal obligation: to comply with the requirements of the Adoption Agencies (Scotland) Regulations 2009; Protection of Vulnerable Groups (Scotland) Act 2007; the Police Act 1997: Looked After Children (Scotland) Regulations 2009 and the Adoption and Children (Scotland) Act 2007.
Article 6(1)(e) Public task – processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Council
We are required to collect the special category information detailed above and the legal basis for doing so is Article 9(2)(a) detailed above and Article 9(2)(h) - for the provision of health or social care and the management of health or social care systems and services and appropriate safeguarding measures are in place.
What we will do with your information?
In order to progress any application you make, we will be required to share some or all of your information with the agencies listed below
Disclosure Scotland - PVG check (Protecting Vulnerable Groups)
Other Council Services for current/previous addresses
Other public bodies including the Police and other local authorities
Current/Previous employers (including voluntary positions)
Previous fostering services or adoption agencies
Schools and colleges currently attended by your children
Health visitors currently allocated to your children
Ofsted/Education Scotland
Personal referees (as listed in your application form)
Children, including adult children
Former partners
State embassy for another country where you have lived
All of the information we collect from you will be processed by staff in the United Kingdom. You should also be aware that your data will be stored on servers located in within the United Kingdom; the data will not be processed outside the European Union. We will take all reasonable steps to ensure that your data is kept securely and more information on how we do this can be requested from the Data Protection Officer.
How long will we keep your information?
We will keep your information for a minimum of 10 years where an adoption order is not made and for a minimum of 100 years from the date on which the adoption order is granted, after this period it will be destroyed under secure arrangements if it is no longer required for the lawful purpose for which it was obtained. More information on our retention policy and procedure can be obtained from the Data Protection Officer if required.
Your Rights
When you provide information to the Council, you will have the following rights:
- to withdraw consent at any time, where the lawful basis specified above is consent
- to lodge a complaint with the Information Commissioner’s Office – see below for details
- to request access to your personal data – please contact the Data Protection Officer if you wish to submit a request.
- to data portability, where the Legal basis specified above is i) consent or ii) performance of a contract
- to request rectification or erasure of your personal data, as far as the legislation permits – please contact the Data Protection Officer and provide details of what data you wish to be rectified or erased.
