Parental Involvement and Engagement - Privacy Statement

A new data protection law was introduced on 25th May 2018. As a result, we've updated our Privacy Notice to make it easier for you to find out how we use, process and protect your information.

Your Personal Data

What information do we need?

Argyll and Bute Council will act as the ‘Data Controller’ in regard to the personal data you provide to us. Argyll and Bute Council need this information about your views to evidence that the aims of The National Action Plan on Parental Engagement, as well as the National Improvement Framework, are being delivered upon as well as for statistical and research purposes.

For the purposes of this specific service, the personal data we request includes special category information about your ethnicity (also known as ‘sensitive personal data’). However questions about socio-demographic data are optional and you can answer at your discretion.

When we are using this more sensitive type of personal information, our legal basis is that we require the information for reasons of substantial public interest for aims that are proportionate and which contain appropriate safeguarding measures. We will also use this information to ensure we are meeting our statutory obligations under the Equality Act 2010.

Why we need this information?

We need this information about your views to:

  • plan and deliver better policies for the benefit of all pupils or specific groups
  • better understand some of the factors which influence pupil attainment and achievement
  • better understand some of the factors which influence parental involvement and engagement
  • share good practice
  • target resources better

You do not have to respond to this survey. If you choose to take part in the survey any questions about your gender, your age group and your ethnic group (called socio-demographic data) are answered at your discretion. This means that you can take part in the survey without the need to answer this category of question. If you start, but do not complete, your survey your answer will still be saved and included in the overall results as a partial response.

Argyll and Bute Council will not publish or make publicly available any information that allows you to be identified, nor will data be used by Argyll and Bute Council to take any direct actions on you or your child/children as a result of this information.

UK GDPR Article 6(1)(c) - the processing is necessary for compliance with a legal obligation to which the data controller is subject as outlined below:

  • Scottish Schools (Parental Involvement) Act 2006
  • Equality Act 2010

Parents do not need to respond to the survey and therefore if they do they are giving consent.

Scottish Government

Your data will be shared with Scottish Government. They will then become data controllers and will analyse the data nationally. They may share the data more widely. Schools will receive an anonymised dataset back in order for them to meet their obligations outlined in the Why we need this information? section

SmartSurvey Ltd

This is the system you will use to enter your responses to the survey. They act as a sub processor of the Scottish Government to collect the survey responses only.

You should also be aware that your data will be stored on servers located within the United Kingdom. We will take all reasonable steps to ensure that your data is kept securely and more information on how we do this is provided on the Council website (www.argyll-bute.gov.uk) or can be provided in paper format on request to your School Support 01369 704000.

Your data will be processed by a designated team and appropriate mechanisms, such as a password, will be used to protect the original dataset from unauthorised access.

How long will we keep your information?

We will keep the original dataset for no longer than a year after the survey close date, after this period it will be destroyed under secure arrangements if it is no longer required for the lawful purpose(s) for which it was obtained. We can hold anonymised data (data that does not identify an individual) for as long as it is required. Automated Decision Making

No automated decision making will take place.

Your Rights

When you provide information to the Council, you will have the following rights:

  • to withdraw consent at any time, where the legal basis specified above is consent
  • to lodge a complaint with the Information Commissioner’s Office
  • to request access to your personal data
  • to data portability, where the Legal basis specified above is i) consent or ii) performance of a contract
  • to request rectification or erasure of your personal data, as so far as the legislation permits
